*After placing lien on client’s account
Former member of the House of Representatives, Hon Ngozika Ihuoma’s lawyers have written the First City Monument Bank Plc (FCMB), to get set for a law suit over the fact that he used his ATM card, while he was debited and he was not paid the cash and got embarrassed over the withdrawal which was not fulfilled.
According to the letter from Apex Precision Law Consult signed by Barrister Sandra Nwosu addressed to the Port Harcourt crescent branch of the bank, Ihuoma on the 9th November 2017 used his ATM card at a Fidelity ATM machine on Ademola Adetokunbo crescent in Wuse II but was debited N10,000 plus N65.00 service charge without being paid by the machine.
He officially complained on the 10th November at the Port Harcourt crescent branch where he was given five to eight working days for the money to be reversed. At the expiration of the time, the money was not reversed.
Ihuoma returned to the bank on the 21st November where he asked for activity report on his complaint in view of the non reversal of the debited sum. He was rather given cash of N10,000 which was unsolicited. Thence, he demanded to sign a legal document to reflect the latest development, this was rejected by the bank officials.
On the 24th November, a credit transaction from a friend of his, Ndubuisi Calistus Azin was made and efforts to withdraw from the account proved abortive. At the FCMB branch at the federal secretariat, he discovered his account had been placed on a lien, without a court order.
His lawyers are asking the FCMB to pay the sum of N10million within 48 hours of the receipt of the letter for the embarrassment, illegal freezing of their client’s account, denial, deprivation and refusal of use of the account by the client.
It would be recalled that Nigerian banks are used to ‘maltreating’ their customers without respect. This is one case of a Nigerian who knows his rights rising to demand respect from the banks. We shall monitor and report the developments as it goes.
