At the last count, the plot has taken its own life for the opposition All Progressives Congress (APC) which has launched a fresh, thicker but more aggressive plan to unseat the Governor of Ekiti State, Mr Ayodele Fayose by impeachment.
Authoritative sources say, “the plan will succeed, we have concluded everything that needs to be done. If heaven I supporting us like she did in the first impeachment.
Part of the plan is to launch a frenzy of fresh legal battles against the governor with the sole aim of unseating the Governor who has spent the better part of his second coming picking and courting controversial storms after the other.
The source told www.gongnews.net that the streaks of legal fireworks hopefully is expected to begin from this month of February.
We (the APC) will use fresh evidence obtained after the previous Supreme Court judgment to nail the governor. When this happens, the APC will ask the Supreme Court to reverse its own judgment based on the incontrovertible fresh and overwhelming evidence indicating the 21st June Gubernatorial election that brought him into office did not in any way reflect the wish of the majority of the people.
The new plan is to make the court understand that Mr Fayose was not even qualified to have contested the election in the first place, having been impeached earlier, a track it was believed the Federal Government under the PDP attempted to sweep under the carpet.
What appeared an astonishing discovery were the billions of cash given to officials of the Independent Electoral Commission, (INEC), Security operatives to skew the election in favour of Mr Fayose and manipulate the end result of the controversial poll.
Other new variables being explored by the APC are the evidences being proffered by some members of the Peoples Democratic Party, (PDP) who are disgruntled with the party hierarchy led by Fayose.
The court will also be asked to interpret sections of the 1999 Constitution which stipulates that a person impeached by the House of Assembly is not competent to contest any other election in the first 10 years of the impeachment.
Mr Fayose as impeached in 2006 by the Ekiti State House of Assembly. Till date, no court of law has squashed the impeachment which had been gazette by the Federal Government. Though, in an unanimous judgment, a seven-man panel of Justices of the court led by Justice John Fabiyi, held that the appeal which challenged Fayose’s election victory at the 2014 Ekiti State governorship election lacked merit. The panel said that the APC failed to prove its allegation that the election was fraught with unparalleled irregularities, adding that the allegation that Fayose tendered forged Higher National Diploma Certificate to the Independent National Electoral Commission, INEC, was not proved beyond every reasonable doubt. The Court also said the impeachment of Mr Fayose in 2014 did not follow due process.
But there have been claims that the pronouncement by the Judges were fraught with irregularities which the APC hopes to challenge with fresh evidence. It is believed that the judgment was influenced by corruption in the judiciary.
The APC will also explore the alleged inconsistencies in the forms filled by Mr Fayose at the Code of Conduct Bureau.
In one instance he was said to have claimed he had N400 million in his account whereas the money in his account as at the time he filed papers was far less than N400 million meaning that the filled form was anticipatory.
